The Telsa DOES NOT HAVE true autopilot.

If you are behind the wheel, you ARE responsible for whatever you ALLOW the vehicle to do. Merely having the capability to take control means you are REQUIRED to do so if necessary to avoid harm.

Currently the driver would be sued (or the owner).  Because all cars currently say that even on autopilot the driver needs to be awake and in control.

But going forward, this isn't a settled question.  What happens when cars a completely automated and there's no driver?  ,No one knows.  This will probably require new laws.

    You are still responsible.

You can be sued as the owner,  just like people who allow others to drive their car and end up in an accident.
