It is a fruit . Only the Federal government, yeah the same slimy idiots that named CO2 a pollutant, decided to call them a vegetable. The reason they did so is a good lesson in the corruption of the government.

Tomato is a fruit. Reason. it carries the seed of the plant for the next generation of plant. However, because of its slightly bitter taste it is treated as a vegetable.
Vegetables do not carry the seed of the plant. However, the 'pea' is a fruit because it carries the genetic information for the next generation. The 'Pea' is treated as a vegetable.
NB The Tomato is an indigenous plant of the Americas, and was brought to Europe several centuries ago., as tobacco, and potato.
The horse is an 'old world' animal, and was exported to the Americas from Europe by the Spanish.

Botanically, it's a fruit; it contains seeds. Legally, the SCOTUS ruled that it is a vegetable because of the way that it is used.
