Who would be at fault in this merging accident situation? (hypothetical)?

If the merging traffic has no where to go in heavy traffic and their lane ends, and they hit the traffic already on the highway, because they didn't let the merging traffic in, then who would be at fault?

  • The cars on the highway already have the right of way the cars comin on gotta yeild so it would be their fault

  • The traffic that is already on the highway or roadway has the right of way cause they are on the road already traffic comin onto the road must yeild

    The idiot who hit someone would still clearly be at fault. No one HAS To let you in.

    The driver merging would be at fault. You have to wait until it's safe to merge into a lane of traffic.

    The merging vehicle has to yield to vehicles already on the highway.

    THIS IS A NO-BRAINER DUMBASS. The merging cars NEVER have the right of way and those already on the highway don't have to let them in. It's pure kindness if they do.

    At fault is whoever did the hitting -- proven by which vehicle has the forward damage.

    The merging traffic would be.  If the lanes ends and no one lets them in, then they have to stop and wait.  The traffic already on the highway does not have to let them in.

    You can't be that stupid. If you hit a car while merging then you are at fault.
