Will anti-vaxers have any legal protections against discrimination in 2021?

What if your job says they will fire you if you don’t get the COVID-19 vaccine? Or what if your university says you cannot be enrolled without it? What if you apply for health insurance and the company jacks up your rate quote because of not having the vaccine?

I know some people who don’t trust the government and will refuse the vaccine. Should those people have rights against educational and employment discrimination?

    They DO have rights against discrimination. However, the situations to which you've alluded are NOT discriminatory. Discrimination is the act of unjust or prejudicial derogatory or injurious treatment of a person or persons with ostensibly (that is save for religious beliefs) immutable characteristics. There's little if anything preventing a person from getting a vaccine. Further, there is no reason why a school should have to subject all of it's students, faculty and staff to the risks desired by an anti-vaxer; nor any reason why an insurance company should assume a higher financial risk in affording coverage to those who want to take on such risks. Skydivers have higher life insurance rates because they put their lives at an unnecessarily greater risk.

    Vaccinations will be for front line workers and those at highest risk first.  It may be 6 months to a year before the vaccination is widely available for everyone.  There is no reason to rush to your doctor as soon as it's available, you can hang back until the tail end.  By that time it should be perfectly clear how safe the vaccination is.  The bottom line is the virus has caused business to have to close and lay off employees, we have to social distance and wear masks everywhere, we can't go out to eat without risking getting sick, we couldn't have the usual family gathering for Thanksgiving and it looks bad for Christmas too.  There are people in the Hospital on a ventilator dying alone because their family can't be near them.  To visit someone in the nursing home we have to visit through glass like they were in prison.  In an at will state, your employer doesn't even need a reason to fire you, sometimes you have to get rid of a bad apple to save the barrel.  They have every right to fire you or refuse to hire you or refuse to allow kids to attend school without proof of vaccination.  COVID-19 is NOT a laughing matter, it is real, just like polio which was also wiped out with a vaccine.

    Public safety is a necessity in a civilization. Anti-vaxxers are not and should not be protected. They should be criminalized.

    One suspects that much like now they'll just be unable to enroll their kids in public schools and be excluded from certain job categories that require vaccination. No, they shouldn't have rights that allow them to make others sick.

    They dont have any legal protection NOW..  They wont have it in 2021 either.

    "Antivaxxer" is not a protected class.

    Health insurance, yes, because the Affordable Care Act (Obamacare) lets you buy insurance through the "exchange" ("marketplace") at whatever the rate there is, and they can't jack up your rate to more than that for any reason.

    Jobs and universities, no.  They can discriminate for any reason except certain specific ones that are prohibited by law. 

    In some places, the law requires universities to discriminate based on vaccination status; it's illegal for them to allow anyone to attend class without vaccination (this doesn't apply to COVID yet, but it does apply to measles), so refusers won't be able to attend any university in those places.

    Jobs vary more in their policies.  A person who doesn't want to be vaccinated could look for a job that doesn't require vaccination -- and doesn't require university attendance.

    There are professions where you have to have all vaccinations, plus negative TB test, etc..  Schools used to require certain vaccines to attend as well.  This is done to protect the general public and this is how they erradicated small pox and nearly eliminated measles, saving hundreds of lives.  So yes an employer can require it, just like they can require a uniform, hearing protection, hard hats, etc,

    You could form a community of people who are not vaccinated against viruses.
