Can a person file a criminal case 1 year after a Temporary Restraining order?
Is there a statue of limitations? A guy filed a restraining order on me for harassment (texts and calls some of them were false and not me) I had a TRO and did not violate it the judge did not extend it and closed the case. I have not had any contact with him in 1 year. Can he charge me with a crime if I have not contacted him at all?

depends on the state....in my state for simple harassment, the statute is 1 year max...and the victim must file the court papers for the charges. after that the prosecutor can choose to pursue the case or not.Source(s): i have a stalker.

No, he can't charge you. He can file a Police Report. And, yes, he can file a criminal case within the statute of limitation. The restraining order doesn't extend that time to file.

He can never charge you with a crime, only the police can do that.

No one but a DA can file criminal charges period.
