USA says China's claim of South China Sea is illegal, but isn't legality written by the victor? If China wins, then it's legal?

Update:

As a member of the UN, China is a signatory to a set of treaty agreements regarding public use of the seas.

If they want to remain in the privileged position they currently hold in the UN, they need to abide by the things they already agreed to.

Most of the area China is claiming is nowhere near China and is traditionally used for fishing by the Philippines Vietnam and Malaysia.

Under international norms the boundarys would be set between those countries.

But, there OIL!! LOTS AND LOTS OF LOVELY, LOVELY OIL under those reefs.

Plus its one of the most important seaways in the world.

I don't think China will push so hard there will be conflict over it, they'll just nibble away bit by bit.

Sure ... China's navy should throw down with the US Navy and we will let the victor decide.
