Why are women less likely to go to prison ?

    Lots of reasons and unfortunately, it's not clear where biology ends and society begins.

    It is true that based on the same crime, same evidence and same circumstances, women are less likely to be convicted than men, and if convicted, less likely to be penalized, and if penalized than receive less penalty than men.

    Certainly, women are more likely to get away with diminished capacity defenses ("insanity defense") than men.  Has any man ever gotten away with the "battered man" defense?

    That being said, at least part of this court bias comes from the fact that they simply see fewer female prosecutions and make assumptions on the basis of who is likely to come in as a defendant vs. who is likely to come in as a victim.

    Since male biology makes it easier for them to win out in violence, they are more likely to try it (women are therefore more likely to use covert means that may well even be legal but still considered underhanded).

    As a society, we defend women where possible because they are so much more valuable for keeping the species going.  Granted, with 7+ billion people on the planet, there is little chance of running out of women to have babies, old habits die hard and societal conditioning doesn't simply disappear.

    And yes, directly associated with being female is the role of nurturing young.  How much of that is biological and how much of that is cultural is currently impossible to tell, but if you put women in the role of nurture all the time, they are less likely to violate it so directly as by committing obvious crime.

    If you put men into the role of providing (for nurturing women and families), they are likely to use whatever means required to do it - which may include simply taking resources from others.

    Certainly women who are desperate for resources are more likely to commit crimes than those that aren't.

    The reasons are complex and difficult to tease apart.

    It's because men always rape, murder, commit crime, breaking the law, and doing violent things.

    Women are the kinder, gentler gender, she's more likely to ask for help rather than kick-butt or steal.

    Society is gynocentric.   Criminal sentencing is no magic exemption.

    Sexist justice system. Females get 63% less prison sentences for a number of reasons, mostly exploiting historical victim status. 

    If you’re a mother, they’ll exploit “primary carer” status. If you’re not a mother, they’ll exploit mental health issues or poverty situations making women appear vulnerable.

    Men also commit way more crime. Why? It’s obvious.

    Crimes that are mental health motivated: 

    If we’re still raising 1 gender to express emotions, even if it’s hypersensitive and not risk it used against them in terms of emasculation and then the other to keep things bottled up until they snap, why are we surprised more males commit heinous crimes? Females with issues often receive treatment at a young age, making them better people into adulthood. It’s only teenage females who act suicidal but usually males who we lose. Adult males with issues often end up in the justice system. 

    Poverty motivated crimes: 

    As someone with a poverty background, I know these people are very simple minded. The man is the breadwinner, the man goes out and gets his hands dirty, the man is the one who gets jailed. He doesn’t get to exploit his victim status. 

    Sex crimes:

    Since men and boys are laughed at for claiming victim hood with regard to sex crimes committed against them by women, it will never be reported.
