Not necessarily; you can live legally in the US on a suitable visa or with a green card.

Is she present in US on a currently valid visa or legal status? E.g. student, employment - although if her school closed or she lost her job, she had to return home as her visa was no longer valid. She legally immigrated & holds legal permanent residency - green card?
If she has some legal status which currently allows her to stay in US, she's legally present.

Plenty of people live in the US as green card holders or on valid visas of various kinds. They are in the country legally.

Not illegal at all. There is absolutely no requirement that anyone physically present in the US is a US citizen.
There are many laws, policies, and different visas however. It is illegal to enter without inspection, or to violate the terms of your visa.

If you aunt is on a valid and current Visa, or is a Legal Alien, no.
If she came here illegally, or legally and overstayed the terms and conditions of her stay, yes.
