Can documents recovered from identity theft be used against you?

Hello. I have a family member who is illegal in our country. Whom is currrently working, he had his passport along with other documents stolen from his vehicle. The U.S postal service and state police department notified him that his documents were recovered but are being used to possibly prosecute. He is worried about police looking into his documents and starting an investigation on him, is this possible? They won't give him his items back until the investigation/prosecution is finished.

    They will do a verification of the documents before doing any criminal case. They didn't give back the documents for a reason!

    Yes, the FORGED documents proving he is an ID thief can be used against him.

    That said, he WOULD NOT have been notified if law enforcement recovered documents they intended to use as evidence against him until they had an arrest warrant.

    Unless the documents were obtained by an illegal search, they can do whatever they want with them

    Prosecuted for what?  Being in the United States illegally?  Yes, the documents recovered in the theft can be used as evidence.
