What legal principles apply when a data breach releases personal financial information? Common law negligence? What statutes govern this?

Why is common law not applicable?  Surely a company owes a duty to use reasonable means to protect personal financial information,

    Federal financial institution or State?  No, it's not common law.

    Statues vary by State.
