Is it fair for a child that the only reason why she is alive today?
Is it fair for a child that the only reason why she is alive today is because there was a surrogacy agreement made before she was conceived that say that her mother has no legal rights over her? If this was not legally biding, than her father would not have allowed his sperm be used to create her. She lives with her grandmother (fathers mother) and she is the one that raises her. Her biological father is a very good father to her.

"Fair" is a matter of morals and ethics. Surrogacy agreements are set aside on a daily basis. They aren't necessarily legally binding.
I don't think a good father shuts his daughter's mother out of her life and leaves the daughter to be raised by grandparents.
Is this in Japan?
