Should police scan Instagram for people doing selfies in the driving seat then prosecute them for using a mobile phone when driving?

I'd be more worried transexuals and peodophiles that empower themselves in immortal armour, so as to evade culpability and whom pull the plug on investigating them whilst being complicit in solicitors fraudulently claiming legal funds whilst using falsified documents after entrapment and misfeasance of the public.
It's a Hell of a long way down from the tree tops.

The police would have no way to prove that the person taking the selfie was driving the car at the time; he could have just been sitting there. There's no law against sitting in the driver's seat and taking a selfie, if you're not driving the car.

The problem is proving it in court.
Someone may take a selfie while the vehicle is stopped or that selfie may not be a selfie but rather a 2nd person in the passenger seat taking the photo. You can't always tell if you can't see the person's arms
