batman believes people can be reformed. that people can try to make amends for their crime. That is why he is a good guy.

It is against his code, plus if he starts to do this, he cannot legally be tolerated by the GCPD, nor Commissioner Gordon, as he is bypassing the justice system, not helping it. To not allow people to have a trial by jury is a big infraction. He cannot choose the fate of people, though there are sometimes when he legitimately cannot save a person. It's amazing how Batman can escape having to testify at a trial. It was decided early on that the character would be more reliant on his martial arts training, his gadgets..etc... rather than using a gun like the character The Shadow. He did use a gun originally. It's up to the justice system to administer what they believe to be an appropriate punishment for Joker's crimes, but the Joker like many people today have found loopholes in the system. Take the Joker movie for example, which is the Joker's narrative of events, and his story isn't even reliable, but the fact that his story makes him out to be a victim, just a mentally ill person, not a sadist, a master schemer...etc.... means he doesn't go to prison like everyone else.

Like many places in the United States, they really don't use the death penalty as much as they should for extremely wicked repeat offenders that do heinous crimes. Now, perhaps some day Batman could decide to "not help" the Joker. In the Batman Beyond: Return of the Joker movie, the original unedited version has young Tim Drake killing the Joker (if spoiler, sorry). The other version made for TV changes that scene to make the Joker die by an accident by being electrocted, to my memory. Whether or not something is canon is up to the writers, who either stick with what other writers have done, or end up going in a different direction. But basically in that movie, Batman and Batgirl end up burying the Joker somewhere secret, and end up keeping it as a secret between them. Others have pointed out that if the Joker is killed off for good, then he can't be used in stories going forward.

Batman will never kill because that’s what separates him from the criminals he fights.
