What is the maximum sentence for Assault?

    There isn't one, as it's a common law offence so no sentence is laid down in written law. This gives the judge, the sheriff or the justices, depending on which court it was tried in, complete freedom to sentence, so in practice it's life and the sentence will be whatever they think fits depending on how bad the assault was.

    It's an interesting thought - in English law, assault is divided into different levels, but in Scotland it never has been. This makes it easier to be on a Scottish jury for an assault trial, because you don't have to decide whether it was GBH or "only" ABH, and you leave the rest to the judge or sheriff.
