If a driver cannot see a person walking, the driver needs to be taken off the road.
In situation you post, with a car in the right lane stopping for the pedestrian, that damn stupid driver passing on the left should have assumed that the car stopped for a pedestrian and the pedestrian was about to appear. IMHO, he should get a ticket for reckless driving.
