No. The original creditor - the person you ripped off will sue you. The collection agency was hired by them to try and collect the debt, to avoid court. If the collection agency is unable to collect the debt, then they inform the creditor (the person who hired them). Your creditor will sue you. The collection agency is not in any position to sue you because they are not owed the debt. If you don't pay your debt, expect to be sued. Court costs, penalties, attorney's fees, collection fees, interest - you will end up owing a whole lot more money than what you owe now, and they do have ways to collect it from you. They won't always be nice about it.

If you run up your credit card then you are responsible for it, so of course you can. Not sure why you would think thats not the case. I would start paying it back any way you can, make sacrifcies elsewhere to start paying it down.

Of course you can. You can get your wages/bank account garnished. All sorts of bad things will happen. Plus your credit will be in the toilet for years.

Collection agencies employ bailiffs to enforce payment. So expect a knock on the door.

Credit card companies count on millions in losses every year. They raise interest rates on everyone else so they never end up losing anything. Your creditor would have sued you before selling the debt. The Collection agency bought it for pennies on the dollar. Getting sued for credit card debt is rare. You owe $4,000 not $40,000. I would not lose any sleep over getting sued.

Employing a collection agency to try and collect is NOT selling the debt.
