If you hit a stationary car then it's not an accident and as you said you drive away then it is crime and come under the category of hit and drive case. Penalty for this offense depends on the rules and regulation of a particular country.

It's not an accident it is a crime and you will be punished as per the rules of the country. For any legal queries, you can visit Lawtendo website. They will suggest you the best way to tackle the situation and also find the best attorneys for you if required.

If you hit a STATIONARY vehicle, it IS your fault.

It may not have been intentional, but is IS your fault.

Driving away from a collision IS intentional and NEVER an accident.

However did you drive away by accident?

You left the scene of an accident in which you were involved: that in itself is an offence

"It's not my fault." Did the police car magically move in front of your car?

My recommendation is to not do so, unless you like jail.

Hitting a car can be an accident.

Driving away after hitting a car is not an accident, it is a crime.

Noting if you're not caught. If you are caught, you'd have a warrant for you for hit and run and destruction of property. It doesn't matter who's fault it is. The law requires you to leave a note and/or identify yourself.
