NO. Police Must ask if they can search. If wife's car and she was driving, cops overexceeded authority. Anything found (If anything, not saying they did) is inadmissible as against 4th, 5th Amendments. They also cannot insist on seeing passenger's ID. He did Not have to surrender it. Get a hold of Citizens' Advisory Committee and file a complaint . If you don't have cop's name/badge number,. a record of the place of pullover, your plate #, and time is public record at cop station. This will have all details.
Only thing Hubby HAS to do is immediately report to P/O any police contact. I note none of the know-it-alls here mentioned This?
Just because cops scanned your tags and found a "relation" is on probation means Nothing. They cannot raid your house, If, Say, your brother has an open warrant for his arrest Unless they have proof Positive you are harboring him. PCSD tried that on Jose Guerena, it is not only illegal, widow sued and got $3.5 million.
I have been on probation/parole. This is BS. Even if I were pulled over s for a suspected traffic infraction. that doesn't give cops Carte Blanche. They Still must ask And I have right to say No and lock doors. Besides, I was not on P and P for drugs, anyway. The agreement on the probation/parole terms I signed was for my Residence, yes, cops/PO can come in search anytime, without warrant, yes. Not my car, did not say this. Nor the bus I am riding in nor a friend's car I am riding in, NO.
And, I remember a car I was a passenger in being pulled over, cop did NOT ask us passengers for ID. We would have stood on our rights and not given it. You don't need ID or a DL to Ride in a car.
