The birth certificate has the names of the mother and father unless the mother is willing to put unknown. The name of the child doesn't change who are the biological parents and doesn't change who is responsible for it.
FYI if she applies for ANY sort of State aid for her or the child, or she goes to court for Child Support the State will request a paternity test of any suspected father, that they will require the mother to provide.
They will at first request you take a Paternity test if you deny it. If you refuse, they will get a court order. If you still refuse you will be arrested and put in jail.
If you are found to be the father, regardless of the name(or no name) on the Birth Certificate the State will come after you. If you fail to voluntarily pay Child Support, then they will garnish your wages. They also could attach your bank accounts and they could withhold any sort of Federal money coming back to you(I.E. Tax refunds).
If they think you are still avoiding paying they will again put you in jail. They could suspend your drivers license. If you have any professional licenses such as a doctor they could suspend that as well.
So she doesn't have to be petty at all. All she needs to do is name you as a possible father and let the State take over.
