Have you read your insurance policy? Probably not. None of us really do. I haven't either. But I do know what goes on in these situations only because I work for a law firm that does insurance defense litigation. Part of the time, I field calls from insureds who are pissed off too because they think the insurance company is pointing fingers at them. Some of these callers are innocent and some of them are the biggest frauds ever. By law, there are certain conditions in your policy with which you must comply in order for them to consider your claim. Perhaps they took your examination under oath at which you provided copies of those phone records and receipts you mentioned? Or perhaps they just requested those documents and have not taken your EUO yet. I am not in Virginia but the law on insurance claims is pretty much the same in the 48 contiguous states.
While three months from your perspective is "freaking long," from the perspective of the insurance company, and from the perspective of the law, it is not. Your insurance company receives thousands and thousands of insurance claims - many of which are fraudulent. It may sound surprising, but lots of people actually make a living off of insurance claims. Some are very good at it. Cars that are stolen and totaled account for a large number.
I am not saying you are fraudulent. What I AM saying is that by law the insurance company is entitled to investigate any and every claim they receive. If there are red flags to a claim, they will investigate further. If, on the other hand, the claim is simple, straightforward and does not even hint at fraud, they can, and often, issue a check in a matter of days. I had a hail damage claim for my car once. Walked into the claim office, and sat. I thought I was waiting for them to call on me. They had actually pulled my car around already. They examined my car, examined all the hail damage, calculated the amount to have the hail damage repaired and cut me a check on the spot. Took an hour.
Insurance claims vary from claim to claim. You have suffered a loss but it is one loss. The insurance company receives thousands of claims and they actually pay thousands of fraudulent claims that they did not know were fraudulent to begin with. By law they have a right to investigate each claim. It's in your policy. I'm sorry for your loss. Truly. But just hold on until they're done.
