Can the case be dismissed at a pre trial conference?

Especially if there are no witnesses that appear?

    Witnesses are not called to Pre Trial conferences in my state. It is the defendant and defense attorney along with the prosecutor. If the prosecutor feels that the case will not stand, he/she can withdraw the charges then, but that is very rare. The PTC is NOT an adversarial proceeding, so no testimony is taken and only motions are put on the record. FYI you can enter Guilty Plea at the PTC if you like.

    Witnesses would not normally be present at a pre-trial conference. The usual way a case would be dismissed at pre-trial would be if the prosecution withdrew.
