Failure/failing to do so?

Which one is better? “Failure to do so” or “failing to do so”?

(1) Failure to do so may affect the employee’s entitlement to compensations per Articles 8, 9 and 10.

(2) Failing to do so may affect the employee’s entitlement to compensations per Articles 8, 9 and 10.

    文法上都成立,但在法律上的意義是有差異。

    Failure to do so , failure 是名詞,單純陳述 "未履行" (omission, failure to act) 的事實,沒有"蓄意或逃避職權"的主觀含意。

    failing to do so,其中failing 是動名詞,有 "抗拒履行" 的意願行為。(含有主觀biased意見)

    法律文件,內文中要表述,"未遵守上述規定" 或 "違反上述規定",習慣用 "Failure to do so may result in...",這是一個固定用語 (set phrase)。

    (我另外查了,A Law Dictionary Containing Definitions of the Terms and Phrases of American and English... 沒有出現任何 failing to do so...)

    在某些時候也可看到下述例子,這些例子都有承接上文的語意,非獨立存在。

    By failing to do so, the employer was found to have accepted that the terms of the original contract would remain in effect.

    Failing to do so will result in the loss of benefits for each day absent without cause.

    Both are fine. Another popular way is "failure in doing so" .
