    There are 50 states. Each state has their own laws regarding rape...depending upon the circumstances and age of the person.

    Death penalty is not given for rape in any state.

    You will have to google each state and find out what their laws are on rape.

    Kennedy v. Louisiana, 554 U.S. ___ (2008) was a decision by the U.S. Supreme Court that held that the Eighth Amendment's cruel and unusual punishment clause did not permit a state to punish the crime of rape with the death penalty if the victim does not die and death was not intended, therefore if a person is convicted of rape he or she is not eligible for the death penalty according to the U.S. Supreme Court's ruling in Kennedy v. Louisiana 554 U.S. ___ (2008).

    Not since 1972 when the death penalty was temporarily suspended in the US by the Furman judgement - the last execution for rape was in 1964 I believe.

    These laws used to operate in a blatantly racially discriminatory manner.

    The great majority of those executed for rape were black and the victim was nearly always white.

    It depends really. I don't believe they can give you the death penalty unless you kill someone.

    But depending on the circumstances, rape can be punished with a life sentence.

    I saw in the news, a serial rapist got 2 life sentences without parole for raping 5 women.
