The best way is get a visa through AIT to disclose the condition to avoid problems. As at the AIT, the fingerprint will be captured. By the fingerprint, your brother will have a easier chance to enter the U.S.
Visa-free travel (with ESTA) also works. However, CBP can only rely on the picture on the passport to determine who he really is.
