AMENDMENT ESCROW INSTRCTION

DUE TO COMPLIANCE CODE VIOLATION RECORDED BY CITY OF FONTANA, BOTH SELLER AND BUYER HEREIN AGREE THAT BUYER SHALL TAKE POSSESSION AND IMMEDIATELY START THE LANDSCAPING IN THE FRONT YARD OF SUBJECT PROPERTY PRIOR TO CLOSE OF ESCROW PARTIES ARE AWARE THAT AT THE DATE OF POSSESSION DELIVERED AND LANDSCAPE WORK STARTE, ESCROW MAY NOT BE CLOSED AND MAY NOT BE IN A POSITION TO CLOSE. BUYER HEREIN FURTHER AGREE TO HANDLE ANY COST AND PAYMENT DUE FOR SAID WORK OUTSIDE OF ESCROW, ESCROW HOLDER SHALL NOT BE FURTHER CONCERNED NOR LIABLE IN CONNECTION WITH SAME.

ALL PARTIES HEREIN FURTHER AGREE THAT THE BUYER SHALL BE RESPONSIBLE FOR ANY CITY INSPECTION FEE AND/OR ADMINSTRATION FEES, PHOTO FEE PER CITY DEMAND SUBMITTED TO ESCROW HOLDER.

UPON STARTING THE LANDSCAPE WORK TOOK POSSESSION OF SUBJECT PROPERTY, BUYER HEREIN AGREES AND ACKNOWLEDGES THAT THEY ARE ENTERING THE SUBJECT PROPERTY PRIOR TO CLOSE OF ESCROW AT THEIR OWN WILL AND/OR RISK AND TO ASSUME FULL LIABILITES AND/OR RESPONSIBILITIES IN CONNECTION WITH THE CONDITION OF THE PROPERTY,BODILY INJURIES, DAMAGES, LOSSES, AND THEFTS(IF ANY). BUYER FUTHER AGREES TO HOLD SELLER, REAL ESTATE BROKERS AND AGENT, AND ESCROW HOLDER HARMLESS FROM ANY CLAIMS, DAMAGES, LOSSES, THEFTS, COSTS AND/OR LEGAL FEES THAT MAY ARISE FRO THE RESULT OF THE EARLY DELIVERY OF POSSESSION TO BUYER OR ACTION RELATING TO SAME.

BUYER HEREBY AGREES TO INDEMNIFY CORPORATE OFFICER, ESCROW OFFICER OF CENTRAL ESCROW, INC., REAL ESTATE BROKER/AGENT, AND SELLER FROM AND AGAINST ANY AND ALL LOSSES AND/OR EXPENSES, INCLUDING ATTORNEY FEES AND COSTS WHICH MAY OR SHALL ARISE OR INCUR BY REASON OF THIS AMENDMENT OR ANY CLAIMS OR ANY ACTION RELATING TO SAME.

Update:

IT IS UNDERSTOOD AND AGREED UPON BY ALL PARTIES THAT NO LEGAL ADVISE OF ANY KIND OR NATURE WHATSOEVER HAS BEEN GIVEN TO ANY PARTY TO THIS AGREEMENT BY CENTRAL ESCROW, INC. AND REAL ESTATE BROKERS/AGENTS.

Update 2:

IT IS FURTHER UNDERSTOOD AND AGREED UPON THAT THE PARTIES HERETO HAVE BEEN ADVISED TO SEEK THEIR OWN SEPARATE AND INDEPENDENT LEGAL COUNSEL FOR THE EXPLANATION AND/OR CLARIFICATION OF ANY OF THE TERMS AND CODITION AS HEREIN SET FORTH.

Update 3:

ALL OTHER TERMS AND CONDITION TO REMAIN THE SAME. ALL PARTIES SIGNING THIS INSTRUCTION ACKNOWLEDGE RECEIPT OF A COPY OF SAME.
