What will happen if a military soldier assaults a civilian ?

    Soldiers are under military jurisdiction so he would be charged with assault under Article 128 of the Uniform Code of Military Justice.

    Surely it depends on the events leading to an alleged assault . . . .

    What if the soldier was attacked and fighting for his life . . . .

    State the events . . . . . Without them your question is useless !

    He gets the civilian punishment, and the military punishment.

    The military will take some of his/her pay, restrict them to post for at least 45 days, give them at least 45 days extra duty, and possibly restrict them to wearing only their uniform. The civilian punishment would vary.

    He would be subject to civilian punishment as well as military punishment.
