If attorney in criminal issue breaches his contract should regular contract damages apply?
Lawyer fails to file appeal and is in breach of contract as well as Strickland v. Washington what damages apply. Some courts hold only your fee being returned is correct for damages. WHAT DOES THE PUBLIC SAY?

Depends on the nature of the breach. In this case, depends on the likelihood of success of the appeal. If the appeal is frivolous and will almost certainly fail, the client may only get nominal damages for breach of fiduciary obligations.
