The term-limits decision was one in which he was the fifth vote with the liberal wing, leaving the conservative wing to dissent.
He's been the fifth vote for the conservative wing far more often than the liberal wing, of course. But I point out the term limits case because it was an extremely rare example of Kennedy disagreeing with Rehnquist, etc., on an issue that pertained to federalism/state powers.
