if some one filed my children and they got audited can i file my own children cause the person didnt have my p?

    Yep, even if they didn't get audited you could. As long as you have custody/proof that they are in your care. To let someone else claim your kids you would have had to sign an 8332 form to allow it. So without that they are in the wrong.

    EDIT: oops, if they have claimed them you will both be audited, and that is when you provide proof.

    I do not know who the person was, but it is probably an ex. But, if the child lives with you then you can use them as a deduction. If not, then they get that deduction. You are not responsible for how they did their taxes.
