Why would Supreme Court Justice Anthony Kennedy swing in favor of illegals in the upcoming Arizona case?

Considering he joined the conservative supreme court majority in delivering a vicious fatal blow to Obama's and Eric Holder's illegals in the Whiting case heard just this year?

Justice Kennedy joined the other 4 Conservative justices to say that states are NOT preempted from making immigration laws and carrying out its own responsibilities guaranteed under the 10th Amendment.

This paves the way directly to say to states Obama doesn't have the power to stop state immigration law that seeks to enforce federal immigration law.

Judgment: Affirmed, 5-3, in an opinion by Chief Justice Roberts on May 26, 2011. Justice Thomas joined the opinion in part and concurred in part and concurred in the judgment. Justice Breyer filed a dissenting opinion, which was joined by Justice Ginsburg. Justice Sotomayor filed her own dissenting opinion. (Kagan, J., recused).

    He probably got paid off under the table like all of the other crooked politicians in Washington.

    Being in favor of the Constitution and being in favor of illegal immigrants are not the same thing.

    Well, as long as states abide by federal immigration laws there is no issue.

    It is those pesky illegal armadillos that are the real problem. And illegal crickets crossing the borders.
