Nude preteen on album cover, legal or illegal? 10 pts?

I am asking for the United States:

The scorpions album "virgin killer" has a nude preteen girl on the cover, is this legal to view or is it considered child pornography? You can easily find it on any search engine.

Or is it legal becuase it is considered art? Please give detailed answer and I will give 10 pts.

Update:

For those who don't know the cover, she is clearly 11-13 years of age, posing provocatively and the only thing covering her genitals is a piece of glass.

    She was a 10 year old named Jacqueline at the time of the shooting in 1976.

    I don't believe it is legal to have a preteen nude on any cover. But that album came out in Europe and was quickly replaced But I would bet that model on the cover is not a preteen at all, but an adult. I am one of those who looked under 21 well into my 30's and was even stopped at 24 years old as looking to young to drive.

    I don't believe it's illegal. The album came out in 1976, a time when I don't think child porn was as hot of a topic. At that time without the internet most people probably didn't know about it. I don't think there's any way a band could get away with a cover like that today.

    I haven't seen the cover. Is it obvious she's under 18 years? Is it animation or the real deal. What about the "Nevermind" album by Nirvana? Where to draw the line? Is it cute or obscene? Innocent or corrupted? What's the intention and action being depicted?

    Now it would not be allowed, however (as was already stated) the album came out in 1976. It was a different time back then.
