I'm having trouble finding a court case, can someone help?
ok, I'm looking for a court case that was influenced by flexible interpretation/judicial activism that is not current and not involving the justices we have today.
The Justice I found so far is Harry Blackmun (but I don't know if I'm going to stick with him, I've been switching around a lot), is he an example of the flexible interpretation model? And what court cases had he influenced that had a flexible interpretation outcome? A court case that has nothing to do with abortion.
Or is there another Justice (that is not on the Supreme Court right now) who have a flexible interpretation? And what court case did he influence with his/her philosophy?
