美國勞工法相關問題

請問舊金山和哥倫比亞區的有薪病假

其薪資是由雇主負擔 還是勞工平常就要捐出公基金 當作資金來源

以及 是否有法規 或判決可以認定 雇主在勞工病假時不需支付薪資

也就是沒有工資續付之問題

我本來以為舊金山地區有薪病假的工資來源是和加州的disability fund拿取的

美國真特別 不像德國有報酬續付法 由法理解釋為什麼勞工不工作還有薪資

可能指導教授留德的 對這方面特別有興趣 也很想知道美國的狀況

所以說 我把他理解成有薪病假 應該算是種福利(benefit)

不太像我們對工資(wage)的想法

是這樣嗎

    In answering your questions:

    1. Paid by the employers.

    2. Unless you are subject to a local law (no state law currently) that paid leaves are mandatory, otherwise paid leaves are up to the discretion of the employers.

    Employers are only obligated to provide leaves under Family and Medical Leave Act as unpaid leaves.

    You are correct. In most of the cases, paid sick leaves are considered as benefit, not entitlement. Such local laws made the leave to become an entitlement.

    However, the issue is how many people are in fact benefit from it? Because:

    正式員工,會告知你一年有多少福利, 薪水, 年假及事假和病假天數, 可帶薪水的, 若超過, 則還是沒有薪水, 而一般, 若不是正式員工像約雇者, 或拿每日支薪者, 沒上班就是沒薪水, 放什麼假都一樣, 有上班才有錢拿.

    至於誰支薪, 薪水都是照拿, 沒問過到底是公司或從工平常就要捐出公基金出來, 不過應是公司吧, 為何是公司基金??

    勞工病假時不需支付薪資

    也就是沒有工資續付之問題??好的公司, 原本設定好的病假天數, 是成文, 好的福利才留得住好的員工, 但超過天數, 當然就不需要負責支付, 詳細應請教公司律師免得觸法,

    勞工基金多用在公會, 公會是用在和雇主打交道, 打官司等等的基金,
