what issue does justice marshall believe is "paramount" to the issue of same sex marriage

    Protecting the welfare of children. (If I read this correctly)

    "Protecting the welfare of children is a paramount State policy."

    "It cannot be rational under our laws, and indeed it is not permitted, to penalize children by depriving them of State benefits because the State disapproves of their parents' sexual orientation."

    (note: I'm not sure this equates to Marshall saying this is paramount to the issue of same-sex marriage, but that'd probably be splitting hairs.)
