Is mediation the same as negotiation?

In the case of Alternative Dispute Resolutions before litigation, is mediation and negotiation the same thing?

    Unless I'm mistaken, Negotiation is when the parties concerned are speaking directly to each other, and Mediation is when "both" parties concerned are speaking to a third party to help deal with differences of opinion or points of "extreme disagreement". I would say that no, they are not the same thing.

    Almost, mediation is with a third, non-concerned party to mediate the negotiation. Negotiation can be done without a third party.
