A Supreme Court ruling that "lobbying" is such a destructive form of speech that it's like shouting "Fire!" in a crowded theatre when there is no fire.
Statistically, over time, if you shout "Fire!" enough times you will get somebody killed.
So, no right under the Constitution is ABSOLUTE.
Not a single right.
Not even "free speech".
When an imagined "right" becomes so destructive of the ends for which society is formed that it threatens to unravel the entire polity, then steps may be taken to re-shape or limit that "right".
All lobbying should be a Federal Felony. It should be just like bribery. It should be regarded as attempted bribery, even if it's just offering "information" so that the member of Congress can be better informed.
The Congressional Research Service operating out of the Library of Congress, set up by Thomas Jefferson should be significantly upgraded so that all members of Congress can quickly and accurately obtain all information they require for their legislative work without any assistance whatsover from lobbyists.
Having removed the last viable premise for lobbying as an activity consistent with the Constitution, a law making it a Federal felony should be upheld explicitely by the Supreme Court in an Unanimous Opinion that brooks not exceptions or loopholes.
After that, 5000 people per year should go to Federal prisons for lobbying, until the business and special interests community gets it into their heads that DOJ has a Zero Tolerance Policy on lobbying.
It would take about 10 years and 50,000 scalawags doing jailtime for the message to get through - OK very nice -- you think Teddy Roosevelt would have hesitated to pay such a small price to clean up the Wh*rehouse that is Washington?
He would pay it gladly, as a Patriot, as a person who wanted to preserve, protect and defend America and it's way of life.
Today we are so sappy we can barely dress ourselves and pick up food from the market. Forget about cleaning up Washington and saving this Democratic Republic.
