BRIDGETON -- A man fleeing police Thursday evening picked up a chair and threw it at the pursuing officer, only to hit a 1-year-old child, city police said Friday.

According to a police report, the mother said the child was not injured by the desperation move by Orlando Perez Cruz, 27, of Bank Street.

Police also said Cruz told officers he was in the U.S. illegally.

Police Chief Mark Ott said on Friday that Federal Immigration and Customs Enforcement (ICE) was notified, but that the agency did not respond at the time, as officials may have been backlogged. Cruz was lodged in the county jail, he said.

According to the police report, events progressed as follows:

An officer pulled Cruz over at the corner of Fayette Street and Cottage Avenue for not having his headlights on.

As the officer approached, Cruz fled the vehicle on foot. Soon after, he threw the chair.

Two assisting officers caught him and arrested him in an alley between Wayne Road and Fayette. They were forced to use pepper spray to subdue Cruz, who resisted "violently."

An officer sought treatment after the incident for a reported knee injury suffered during the chase.

Cruz was charged with aggravated assault, simple assault, obstructing the administration of justice, resisting arrest and hindering apprehension/prosecution.

He also had four warrants for failure to appear, two in Seabrook, one in Fairfield Township, and one in Cumberland County Court. He was lodged in jail without bail

    Good thing I was not that child's parent. He should be charged with child abuse along with his other charges of assaulting a police officer. This is something we are seeing too much of, when illegals are caught and jailed for an offense and then released on own or bond, they run. They just relocate to another area of the country and go by a new I.D. but advocates will say something in his defense, knowing that taking up for people like this only hurts their cause.

    If you fail to appear at a small claims hearing, the default judgment goes to the plaintiff (I"ll assume you would be the defendant). Typically, you'll receive a notice from the court advising you of their decision and the monetary settlement you will now be responsible for. Do yourself a favor: show up and take care of this matter in a responsible manner. You'll sleep better at night. Good luck.

Suffering severe head fractures and extensive brain damage, he died two days later.33 Keith Phoenix, 28, and Hakim Scott, 25, were indicted on March 3, 2009. The two men were charged with second-degree murder, manslaughter and assault, all as hate crimes, and could face 78 years to life in prison. Both men claim that they are not guilty.34

    On Long Island, New York on November 8, 2008, Marcelo Lucero, a 37 year-old Ecuadorian real estate agent, was beaten and fatally stabbed by seven teenagers who were driving around to "go find some Mexicans to f— up." The teens spotted Lucero and a friend, then proceeded "[l]ike a lynch out of their car and surrounded Mr. Lucero," beating and stabbing him, according to the local prosecutor. The teenagers, all 17 and 16 years old, were charged with felony gang assault. One of them was also charged with manslaughter as a hate crime.
