Is it the US govt's right to demand that UBS hand over the names of 52k Americans who have accounts?

in Switzerland in regards to tax evasion? The bank has already admitted guilt in US court for assisting Americans in evading taxes. If they refuse to cooperate, wouldn't they be in violation of the Patriot Act? If UBS refuses, should Uncle Sam kick the bank out of the US and prohibit them from doing business with Americans? Then simultaneously put an embargo on Swiss banks prohibiting Americans from using them?

If you disagree with all this, what should be done then about US lawbreakers? Or is tax evasion not a crime? What would the IRS do to you if you were caught evading taxes? Why should these people be treated differently?
