More the drunk drivers fault because it's illegal. Drunk driving slows your reflexes too. Also, sometimes if your paying attention to the road while talking sometimes you might be able to drop the phone and turn the car real fast. But the person talking on the cell phone would get a ticket too because it also slows your reflexes since you are not paying attention to the road. btw i luvvv ur avatar!! (i luvv cats)

depends on the situation
usually would be the drunk driver in most cases
however it could be contested in the way that the cars crash so the drunk driver would automatically get a DUI and the cell phone driver would probably get charged with wreckless driving... depends if the law has changed yet ...

The drunk driver. The person on the cell phone can shove that thing under their seat but good luck getting rid of all that alcohol you consumed before the cops get there.
Plus even if the drunk driver saw you talking on it ....who believes a drunk? They'll forget it by the morning anyway.

Drunk Driver because a cell phone driver can put down his phone and a drunk driver can't put down his drunk.

Cellphones can't drive!!!
HA I would say the drunk driver because he intentionally got into the vehicle and behind the wheel knowing he was unable to drive

depends on the situation, but likely the drunk driver as that impairs your cognition further than talking and driving.
furthermore, driving drunk impairs the cognition of both sexes equally, while talking on a cell phone is worse for males as females can multitask better...due to a larger connection between the cerebral hemispheres known as the corpus callosum.
Source(s): try to avoid taking cell phone calls when you drive, but... NEVER DRINK AND DRIVE! - FUNdieLv 71 decade ago
They would both receive citations, but the drunk driver would receive the stiffer penalty, because you can always put a cell phone down. You can't just suddenly "stop" being drunk.

the drunk driver, but if the person on the cell phone had been paying attention the accident may could have been avoided.
