Is partial birth abortion, still legal?

    NO!!!!

    It has been outlawed since 2003. I wish SOME people in this forum would actually read the Supreme Court Ruling....for those who said 'yes'//

    "The Partial-Birth Abortion Ban Act (Pub.L. 108-105, 117 Stat. 1201, enacted November 5, 2003, 18 U.S.C. § 1531[1], PBA Ban) is a United States law prohibiting a form of late-term abortion that the Act calls partial-birth abortion. The U.S. Supreme Court has ruled that the term "partial-birth abortion" in the act pertains to a procedure that is medically called intact dilation and extraction. Under this law, "Any physician who, in or affecting interstate or foreign commerce, knowingly performs a partial-birth abortion and thereby kills a human fetus shall be fined under this title or imprisoned not more than 2 years, or both." The law was enacted in 2003, and in 2007 its constitutionality was upheld by the U.S. Supreme Court, in the case of Gonzales v. Carhart."

    In some sense, yes it is still legal. Under the partial birth abortion ban act, anybody to carry out an abortion in the second trimester would be considered ILLEGAL. However, if the mother should need medical attention by having this child, it is still legal. In all cases considered, if the mother will die, it is legal, if she will not, it is not. Unfortunately, this does not address instances of rape and sexual mistreatment as a proper excuse, per se, to receive this medical treatment. So in a most broad answer...no, partial-birth abortion is not legal.

    The Partial Birth Abortion Act of 2003 generally bans them except to save a woman's life. The Supreme Court held it was Constitutional in 2007.

    President Bush completely Baned Partial Birth Abortion in 2007. It is no longer legal but it is still performed illegally.

    It is legal. Sadly. I am Pro-choice. But I think partial Birth Abortion is completely wrong

    where do you live? i know that abortion is legal in california and im pretty sure in the rest of the country. but im not sure about the entire country.
