Thank you for contacting me with your concerns about the validity of President Barack Obama's citizenship records. I appreciate learning your views, and I value your concerns.

The Constitution requires the president to be a 'natural born citizen'. Officials in the state of Hawaii have determined that President Obama was born in Hawaii, and he is therefore eligible to serve as president. The President's background has been thoroughly researched by the media and watchdog groups, and he has been voted into office in a legal, democratic process as befits our Constitution.

    Jerry McNerney apparently doesn't know his Constitution. A person has to be a "natural born citizen" to be President of the United States.

    There is a difference between a 'citizen' and a 'natural born citizen'.

    A 'citizen' can be a naturalized US citizen by immigrating to the US and applying for citizenship, a native-born citizen by just being born in the US, or a citizen by descent by being born to a US citizen parent.

    A "natural-born citizen" is someone who was born to two US citizen parents on US soil.

    Rep. John Bingham of Ohio, chief architect of the 14th Amendment's first section, considered the proposed national law (The Civil Rights Act of 1866) on citizenship as “simply declaratory of what is written in the Constitution, that every human being born within the jurisdiction of the United States of parents not owing allegiance to any foreign sovereignty is, in the language of your Constitution itself, a natural born citizen…” (Congressional Globe, 39th congress, 1st session, March 9, 1866) http://memory.loc.gov/cgi-bin/ampage?collId=llcg&f...

    "Not owing allegiance to any foreign sovereignty" is the key phrase here. Both parents had to be US citizens, neither could be a non-US citizen because then they would owe allegiance to a foreign sovereignty.

    The Supreme Court case of PERKINS v. ELG (1939) defined a natural born citizen as a person who was born on US soil to two US citizen parents.It defined it in two places; once by declaring Ms. Elg a "natural born citizen" (she was born to two Swedish immigrant naturalized US citizen parents on US soil) and once by citing the Steinkauler case, in which a young man was born on US soil to two naturalized US citizen parents and said of him "in due time, if the people elect, he can become President of the United States"

    It was also defined in MINOR v. HAPPERSETT (1874) http://caselaw.lp.findlaw.com/scripts/getcase.pl?c... where the court said "At common-law, with the nomenclature of which the framers of the Constitution were familiar, it was never doubted that all children born in a country of parents who were its citizens became themselves, upon their birth, citizens also. These were natives, or natural-born citizens ..."

    In the Supreme Court case of Kwock Jan Fat v. White, 253 U.S. 454 (1920) The father of Kwock Jan Fat was a native-born US citizen, born on US soil of Chinese nationals.     Kwock Jan Fat was Born of two US citizens on US soil and thus a "natural born citizen."

    Barack Obama's father was not an immigrant to the US. He was in the US on a student visa and was a British/Kenyan citizen. He never had "legal resident" status and he never applied for US citizenship.

    Congress has tried to expand the definition of "natural born citizen" in the past, with S. 2128 [108th]: Natural Born Citizen Act. This bill never made it past the Committee on the Judiciary because it was an attempt to change the Constitution with legislation instead of by amendment.

    There would have been no need to try to expand the definition this way if any person born in the United States or any person born to one US citizen parent was already considered a "natural born citizen" according to the Constitution.

    Obama isn't a Constitutionally legal President because he wasn't born to two US citizen parents.

    sounds like your question was answered. Obama's birth certificate is consistent with a birth announcement in a honululu newspaper in 1961. As far as releasing an actual 46 year old piece of paper, the burden of proof is on those claiming the state of Hawaii is acting in a fraudulent manner. Obama is entitled to privacy, just like anyone else.

    BTW, would love to see that evidence Obama was born in some place other than Hawaii, always open to changing my mind.

    Of course, Philip Berg comes off as a nut with claims Obama was not a natural born citizen even if he was born in Hawaii.

    In the day and age we live in, with computer tech being what it is; I have been scratching my head about why, there is no copy of his birth certificate floating around on the web. Has anyone seen one?

    Gee, I had to show my original birth certificate for my lowly pay-grade beneath him job.

    Foreign births are registered in Hawaii!

    I still don't see why he doesn't publish a copy of his birth certificate for all to see, if he was actually born here, if he did that he would shut everyone up and that would be the end of it. The fact that he refuses to produce it only proves he is hiding the truth.

    This does it for me. http://msgboard.snopes.com/politics/graphics/birth... There are plenty of reasons not to consider him suitable as the president of the United States. Foreign birth is not one of them apparently.

    but no copy of the birth certificate, ay? If his citizenship has been determined ( look that up in webster's) then why is it that on www.obamascrimes.com they are suing..unh, I've been shot!

    Any document can be forged! I still don't think he was born in the states.

    not sure what your agenda is, to verify his eligibility or to see the document. The document is available to those with a legitimate reason for seeing it. funny how the cons complain about this but had no issue with their golden boy defying legal subpoenas from Congress.
