i made 45000 last year, my girlfriend made 0. we have 2 small children, how should we file?

    You may be able to file as head of household if you meet all the conditions. You cannot file as married.

    You can be head of household. You may also be able to claim your girlfriend if she lived with you all year, did not earn more than $3,500 and your relationship does not violate local laws.

    If the kids are your kids, you can claim them as qualifying children and file as head of household. You might also be able to claim your gf as a qualifying relative (I know, she isn't a relative, but that's the term the IRS uses). She won't file since she had no income.

  • do you'll live together first of all?if so you can file head of household and claim the 2 kids dependents and your girlfriend as a qualifying relative.

    in order for you to do this you'll had to be living together for at least the last 6 months of last year though.
