    It depends on what you want from ADR. If you want cased handled faster, cheaper, and with more privacy than traditional litigation, then it has been a success. If you want public castigation of wrong-doers or precedent-setting cases, then ADR has detracted from those goals.

    If you mean, 'did ADR significantly lessen court backlogs?' then the answer is 'not really' because ADR has not (and may never be) embraced by lawyers, and clients listen to their lawyers' advice.
