Typical requirements for residency determination include:
Most states require a durational residency requirement (usually 12 months). Tennessee is the only state that has no durational requirement. Arkansas requires 6 months. Some states require two years, such as California and Arizona .
- Some states may also have a minimum age requirement for independent students to qualify as in-state residents (e.g., 19, 21, 23, 24), but may allow legally emancipated minors to qualify is they satisfy the durational requirements. Nebraska does not have a minimum period of residency for parents of dependent students, but uses the one-year standard for independent students. Some states (e.g., Minnesota ) require a full calendar year of residency and not just twelve months prior to the first day of classes.
The intent to maintain domicile or be a permanent resident of the state for the foreseeable future.
The determination as to whether a student qualifies is made by the tuition classification officer (usually someone in the Office of Admissions or Registrar) at each college or university. Each college's decision is binding only at that college. There is usually no appeal beyond the university. Be ready to provide proof of residency and intent to remain a resident. Examples may include:
Car or voter registration
Income tax returns with an in-state residential address.
Some states require you to claim yourself as independent for at least 2 years.
Records of attending secondary school in the state
State driver's license
Home ownership in the state
Local bank account
Records of full-time employment in the state
Local civic group or club involvement

Keep in mind that these examples are provided as a guide. No state has a comprehensive list that automatically grants resident status. It also may vary by state. Exceptions are often made for military personnel, teachers and government employees.
