If you get a sentence is prison, how long do you have to serve before you apply for probation?

I had heard something like if you serve a sentence you have to serve 1/3 of it before you can apply for probation?

    First of all, what you serve after prison is parole, not probation. Probation is what you receive instead of a prison sentence.

    Now, many states have done away with parole altogether. And when/if you would be eligible is entirely dependent upon the state you are incarcerated in. And you don't "apply," you simply reach your eligibility date and receive a hearing date before the parole board.

  • You do not apply. Good time is figured into the equation, if you do it, and you will be notified through the process. You also must understand the laws in the state you were sentenced.

    you dont apply for probation either you appeal or you wait for the min. sentance till you can apply for probation.
