    The Partial-Birth Abortion Ban Act of 2003 bans one form of late term abortion called "intact dilation and extraction" in the U.S. The Supreme Court upheld the law as being constitutional in 2007 in Gonzales v. Carhart.

    First of all, "Partial Birth Abortion" is a political term, not a medical term. That makes this an extremely difficult subject, as proponents and opponents don't even agree on a definition.

    The procedure is also known as "dilation and extraction," or D&X, and "intact D&E". The procedure is most commonly performed in weeks 20-24 of the pregnancy. Approximately 0.2 percent of abortions performed in 2000 were of this variety. Contrary to what abortion opponents claim, almost no abortions are performed in the third trimester.

    Many states have banned such procedures, but they are generally struck down when challenged in court for being far too vague. That's the point, though. Those pushing through bans on such procedures do so in a way which opens the door for outlawing all abortions. Then, when a politician (Obama) votes against such bans, they are labeled "baby-killers' or some other nonsense, when in fact he is simply protecting a woman's right to choose from these back-door attempts to outlaw all abortions.

    Actually, they are legal, however the Bush administration has made it much harder to get them. However, Obama has already said that his first act would be to pass the "Freedom to Chose Act" and that would make it much easier to get partial birth abortions - all the way up to full term. So, in sense, a woman could decide that she can abort while she is in labor. They will kill the baby on the way out and the woman can go home guilt free.
