Occupational Safety and Health
The Occupational Safety and Health Review Commission (OSHRC) was created under the act and empowered to review acts of the labor secretary concerning the enforcement of OSHA. This Review Commission has three members who are charged with ensuring objective administration and judging substantial compliance with standards. It is an administrative agency with quasi-judicial powers to arbitrate contests between the labor secretary and the employer. Administrative judges are assigned by the chairman with duties to conduct a fair and impartial hearing, assure relevant facts are fully brought out, and adjudicate issues and generally avoid delays. A judge can dismiss contests where there is refusal to testify, follow his or her directives or file pleadings when due. The Review Commission does not have the power to enforce its orders or punish for contempt; these actions must be taken to court.
The Review Commission generally judges the employer’s substantial compliance by the facts in each individual case and by what a reasonable person of ordinary prudence would do under the same circumstances-that the employer was reasonably diligent under the circumstances in protecting employees. Another important factor taken into consideration for penalty assessments-and at hearings for contests, abatements or variances-is the good faith of the employer regarding implementation of OSHA rules and standards.
