    Ohio is a "one party consent" state. This means only one person needs to know. However, Floridia is a two party consent state, meaning all persons must be aware of the recording. This could cause problems.

    Twelve states currently require that BOTH or ALL parties consent to the recording. These states are:

    Connecticut

    Florida

    Illinois

    Maryland

    Massachusetts

    Michigan

    Montana

    Nevada

    New Hampshire

    Pennsylvania

    It depends on what Ohio's wiretapping laws are. Under Federal wiretapping law, it is legal to record a telephone call if at least one party to the call knows it is being recorded. However, that is true only IF an individual state does not have a stricter law on the subject.

    You can tape a phone call without the other persons knowledge as long as you are the person they are talking too, i.e. not a third party.

    You can not record a person without their consent. There are many times where someone will record someone saying that they did something illegal but we end up taking the person who recorded stuff to jail because it is in invasion of privacy and the privacy act. It is a federal offense.
