雙重國籍兵役問題

我想請問一下. 如果持有雙重國籍(美國及台灣)ㄉ人回台灣當兵, 美國國籍是否會被美國政府取消? 因為我看到U.S. Department of State's advice about possible loss of U.S. Citizenship (1)"obtaining naturalization in a foreign state (Sec. 349 (a) (1) INA)" and (2)"entering or serving in the armed forces of a foreign state engaged in hostilities against the U.S. or serving as a commissioned or non-commissioned officer in the armed forces of a foreign state (Sec. 349 (a) (3) INA)"

如果回台灣當兵, 美國政府是否會因為知道有雙重國籍而取消美國國籍? 還有commissioned or non-commissioned officer in the armed forces of a foreign state, 這個意思是不是說在其他國家當兵, 美國國籍就會被取消?

我想問ㄉ是如果持有雙重國籍(美國及台灣)ㄉ人回台灣當兵, 美國國籍是否會被美國政府取消? 因為我在U.S Department of State 看到 possible loss of U.S. Citzenship 有提到 serving as a commissioned or non-commissioned officer in the armed forces of a foreign state. 這個意思是不是說在其他國家當兵, 美國國籍就會被取消? 感謝~

了解ㄌ. 謝謝你ㄉ知識. 因為我在十八歲時才出國ㄉ. 所以沒辦法辦理僑居. 還有這句話ㄉ意思"obtaining naturalization in a foreign state (Sec. 349 (a) (1) INA)" 是不是只拿到美國國籍後不能再拿其他國家ㄉ身分. 但在拿到前已有其他國家身分是可以的? 謝謝~

    國務院網站上的法規中 第一段一定要看清楚:

    Section 349 of the Immigration and Nationality Act (8 U.S.C. 1481), as amended, states that U.S. citizens are subject to loss of citizenship if they perform certain specified acts voluntarily and with the intention to relinquish U.S. citizenship.

    你並沒有放棄國籍的意願吧?

    美國是個所謂的"人權"國家 即使你去伊拉克參加聖戰 也不會有"自動"喪失US citizenship的情況發生 不用擔心去台灣當兵會有悲劇發生

    基本上你所提的這些行為 你的意圖若不是為了放棄美國國籍的話 就不會有問題 就算你有此意圖 也需要駐外領事跟你certify你的意圖 只要你說你的意圖是保留美國國籍就可以 根本沒有像李慶安說的美國國籍會自動消失的情況

    在台灣當兵真的是小事 AIT不會派領事來調查你的"意願"

    the consular officer will simply ask the applicant if there was intent to relinquish U.S. citizenship when performing the act.

    If the answer is no, the consular officer will certify that it was not the person's intent to relinquish U.S. citizenship and, consequently, find that the person has retained U.S. citizenship.

    喔!加入美國籍不是要宣示效忠美利堅合眾國?來到台灣當兵不是要宣示效忠中華民國政府?莫非阿美利加跟不爭氣的台灣一樣承認雙重國籍!這個問題就要請教怎們的外交部長ㄌ!

    這個條款是說不能在與美國敵對的國家當兵, 或者擔任其他國家軍隊的官職或被授權的非官職.....

    基本上, 你只要不是士官, 或者最小到當班長, 一般兵是沒有影響的....

    你不能拿僑居嗎??

    美國公民的身分要被取消其實比較不容易...除非真的是叛國.....另外就是, 台灣的身分比較奇怪, 所以還好...畢竟全球沒多少國家承認台灣是國家...

    Taiwan law provides for compulsory military service. Men between the ages of 18 and 36 who were born in Taiwan or who have ever held a Taiwan passport should be aware that they may be subject to compulsory military service in Taiwan, even if they are also U.S. citizens, and even if they have entered Taiwan on U.S. passports.

    Potentially affected individuals are urged to consult with the nearest office of the Taipei Economic and Cultural Office (TECO) in the United States before visiting Taiwan to determine whether they are subject to the military service requirement. Visit www.roc-taiwan.org for more information.

    Dual nationals currently in Taiwan can contact the Overseas Chinese Affairs Commission at 02-2327-2600 ext 2929 or visit www.ocac.gov.tw for more information.

    Possession of U.S. citizenship does not prevent Taiwan citizens from being subject to this law. If an individual is considered a Taiwan citizen at birth, he retains that status even after acquiring U.S. citizenship. Under Taiwan law, he may not abandon his Taiwan citizenship until after age 36.

    The United States Government cannot protect dual nationals from compulsory military service.
