some info on NY sales tax policy?

A customer at my workplace (Radioshack) complained about the sales tax on a $50.00 itunes card, saying that it wasn't legal for us to charge the tax. Is it really illegal to charge it, or can someone point me to a website that can show proof?

    I'm not certain, but it seems to me that if the purchase was made in the state of NY, the customer owes the sales tax. If he was outside the state and bought the card online, then its possible he wouldn't have to pay the tax. But he apparently went inside the store in NY, thereby becoming liable
